The Kennedy Patent

Archibald Kennedy PatentRightThe Elliot-Buckley House lies within the virtual lines marking The Archibald Kennedy Patent,which reads, “George, by the grace of God King of Great Britain, France and Ireland Defender of the faith and to all to whom those present shall come or is any way concern greetings. Whereas our loving subject Archibald Kennedy by his Petition Presented to our right trusty well beloved Robert Hunter Esq. Captain General and Governor in Chief of our Province of New York Grant 1,200 Acres on the 7th day of August 1715.” This land was parceled out of the 300,000 acres of the Evans Tract, given to Captain John Evans, Commander of the Frigate Richmond, on September 3rd, 1694. This area was on the southern border of the New Paltz Tract, which the Palatines bought from the Esopus Indians. Evans had petitioned Benjamin Fletcher, Governor in Chief of the Province of new York, during the reign of Queen Mary II, 1689-1702.

The Evans Tract commenced on the Hudson River at the south line of the New Paltz tract, then went westerly to the Shawongunk Mountains; thence southerly to the southwest corner of the present Mount Hope; it proceeded easterly to the Hudson River, thence to the place of beginning……The patent was canceled on or about the year of 1698 because it was the most extravagant Patent issued.

Land patents are a form of land leases which grant rights, but not a title, for use of the land for some consideration, usually taxes or rent, usually payable in those times on Lady Day (25 March), The Catholic Church fixed this date for St. Mary’s festival on the 25th of March each year, making it 9 months (39 weeks and 2 days to be precise) until 25 December, Christmas Day, the date on which the Church chose to celebrate the birth of her son.
Lady Day was the first of the quarter days in a year (marking the 4 quarters of the year), and thus was the fiscal beginning of the year, because the year’s measuring system, A.D. (Anno Domini, year of our Lord), is technically supposed to be measured from the day Christ was first incarnated inside Mary. That’s why around this time of year many income taxes are still due, many government fiscal years end, etc. as an inheritance from very old fiscal systems.
Up until England changed to the Gregorian calendar in 1752, Lady Day was considered to be New Year’s Day. Accounts were expected to be settled or at least recorded, and rents paid. Thus, for some governments today, their fiscal year end falls around this time still.
